Cuban, the owner of the NBA's Dallas Mavericks, was asked on the Dan Patrick Show Thursday: "What would stop you from signing Colin Kaepernick as an NFL owner?"

"Whether or not he could play," Cuban said.

"That's it?" Patrick asked.

"Yeah."

"Even in that state?"

"It depends on the market you're in," Cuban said. "What's changed is, in the past, there would have been 10, 15, 20 beat writers that would have had to write something every single day. That's not really the issue any longer, whether it's bloggers or newspaper beat writers or even local media. Now the issue is social media and how each team is prepared to deal with that. And, to a lesser extent, national media.

"But, yeah, if he could play, winning cures all. What he did in speaking up for himself, would not prevent me from signing him. No."

Kaepernick, the former San Francisco 49ers quarterback, began the national anthem protest movement by kneeling last season.

He remains unsigned and has filed a complaint that team owners colluded against him because of the protests, which are aimed at police brutality against African-Americans and other social justice issues.

Houston Texans coach Bill O'Brien said his team had discussed Kaepernick as a possible signee after starter Deshaun Watson went down with a season-ending injury, but they didn't follow through.
